These Terms and Conditions (the "Terms") govern your use of the website www.kaleidisco.party (the "Site") and the silent disco rental services (the "Services") provided by Kaleidisco ("we," "us," or "our"). By accessing our Site

or using our Services, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms
By using our Site or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access our Site or use our Services.

2. Services

Kaleidisco provides rental services for silent disco equipment, including but not limited to headphones, transmitters, and related accessories. The specifics of your rental, including dates, times, location, and equipment, will be outlined in a separate agreement or booking confirmation.

3. Booking and Payment

Booking Requests: All booking requests are subject to availability and our confirmation.

Quotes: Quotes are valid for a specified period and are subject to change.

Payment: Payment terms, including deposit requirements and final payment due dates, will be specified in your booking confirmation or agreement. We accept various forms of payment as indicated on our Site or during the booking process.

Cancellations and Refunds: Our cancellation and refund policy will be outlined in your booking confirmation or agreement. Please review it carefully.

4. Use of Equipment

Responsibility: You are responsible for the care and security of the rented equipment from the time of delivery until it is returned to us or picked up by us.

Proper Use: You agree to use the equipment in a safe and responsible manner and according to any instructions provided by us.

Damage or Loss: You are responsible for any loss, theft, or damage to the equipment (beyond normal wear and tear) that occurs while it is in your possession. You agree to pay for the repair or replacement of any such lost, stolen, or damaged equipment at our standard replacement cost.

Alterations: You shall not alter, modify, or attempt to repair the equipment without our prior written consent.

5. Delivery and Setup

Delivery and Pickup: Arrangements for delivery and pickup of the equipment will be agreed upon during the booking process. You are responsible for ensuring that the delivery and pickup locations are accessible and safe.

Setup (if applicable): If setup services are included, we will make reasonable efforts to set up the equipment according to your instructions. However, you are ultimately responsible for the suitability of the location and any necessary permits or permissions.

6. Event Conduct

You are solely responsible for the conduct of your event and ensuring that all attendees use the equipment responsibly and in compliance with any applicable laws and regulations. We are not responsible for any incidents or damages arising from the misuse of the equipment or the conduct of your event.

7. Intellectual Property

The content on our Site, including but not limited to text, graphics, logos, images, and software, is our property or the property of our licensors and is protected by copyright and other intellectual property laws. You may not use, reproduce, or distribute any content from our Site without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Kaleidisco shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for lost profits, data loss, business interruption, or personal injury) arising out of or relating to your use of our Site or Services, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these Terms or our Services shall not exceed the total amount paid by you for the specific Services in question.

9. Indemnification

You agree to indemnify, defend, and hold harmless Kaleidisco and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of our Site or Services, your breach of these Terms, or your negligence or willful misconduct.

10. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or our Services shall be exclusively resolved in the state or federal courts located in Ada County, Idaho, and you hereby consent to the jurisdiction of such courts.  

11. Entire Agreement
These Terms constitute the entire agreement between you and Kaleidisco with respect to the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether oral or written.  

12. Modifications to These Terms

We reserve the right to modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on our Site. Your continued use of our Site or Services after the posting of revised Terms constitutes your acceptance of the changes.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
